(Oral) Present petition under Section 528 BNSS, 2023, has been filed for quashing of order dated 02.08.2025 (Annexure P-4), passed by, Special Court, Mansa, whereby warrants of arrest were issued against the petitioner in FIR No.112 dated 17.08.2021 under Sections 15/29 of NDPS Act, registered at Police Station Bareta, District Mansa, Punjab. The relevant facts of the present case for adjudication are that the petitioner is facing trial in the afore-said case and had been granted bail by Special Court, Mansa, on 20.09.2021. Petitioner had been regularly appearing before the trial Court. However, on 02.08.2025, the petitioner was unable to appear before the trial Court and his bail order was cancelled and bail/ surety bonds were forfeited to the State and he was ordered to be summoned through non-bailable warrants.

It has been contended by learned counsel for the petitioner that the absence of the petitioner on 02.08.2025 was neither intentional SANGEETA 2025.11.12 14:08 I attest to the accuracy and integrity of this document

CRM-M-61671-2025 rather for the reason that he was not aware about the pendency of the case as he was under the impression that case is closed due to death of co-accused, due to which he could not appear before the trial Court on the aforesaid date. He further submitted that now the matter is fixed for 04.12.2025 before learned trial Court and the petitioner is ready to surrender before the trial Court and requested that the impugned order dated 02.08.2025 be set aside.

Heard.

Considering the facts and circumstances of the present case and to enable the petitioner to join the proceedings pending before the trial Court and to expedite the proceedings in trial, the impugned order dated 02.08.2025 is set aside. The petitioner is directed to surrender and appear before the learned trial Court within 10 days and on doing so, he would be released on bail on furnishing his fresh bail/surety bonds to the satisfaction of the Court concerned and with the undertaking to appear regularly before the trial Court on each and every date of hearing subject to depositing of Rs.6000/- with DLSA, Mansa.

Disposed of in the aforesaid terms.
