The jurisdiction of this Court under Section 483 of BNSS has been invoked for grant of regular bail to the petitioner in case FIR No. 96 dated 15.05.2025 under Sections 137, 140(3), 65(1), 96 of BNS and Section 6 of POCSO Act, registered at Police Station Sadar, District Palwal. 2.
the allegations of restraining the prosecutrix and committing wrongful acts with her have been leveled only against co-accused Shivam. There is no evidence on record that points towards the complicity of the petitioner. "# $

It is further submitted that the material witnesses in the present case have already been examined, all of whom have turned hostile before the learned trial Court. Reliance in this regard is placed on Annexures P-11 to P-13.
Learned counsel submits that the 29 year old petitioner has
already undergone an actual custody of 09 months and 19 days and has clean antecedents.

Per contra, learned State counsel has vehemently opposed the submissions made by the learned counsel for the petitioner. She states that the petitioner was actively involved in the commission of the offence. She has filed custody certificate in Court today and the same is taken on record. As per custody certificate, the petitioner has undergone an actual custody of 09 months and 19 days. The learned State counsel, on instructions from official concerned, submits that in the present case, charges were framed on 03.10.2025 and out of total 25 prosecution witnesses, 06 have been examined till date. He submits that in view of the serious allegations against the petitioner, he is not entitled to the concession of regular bail. 4.
