The present contempt petition has been filed for deliberate and intentional disobedience of order dated 18.09.2025 passed by the Division Bench of this Court in CWP-27957-2025, whereby the following direction was passed:- "3.

In view of the above, this court by way of writ of mandamus directs Respondents No. 2 and 3 to execute the order dated 31.12.2024 (Annexure P-4) passed under Section 14 of SARFAESI Act by handing over physical possession of the secured asset to the petitioner-Bank as expeditiously as possible, preferably, within a period of 30 days. The petitioner-bank, thereafter, can proceed to adopt all possible legitimate means to liquidate the secured asset to recover the due amount."

COCP-5413-2025 (O&M) -2way of affidavit dated 01.05.2026 of Rajesh Dhiman, IAS, Deputy Commissioner, Bathinda, along with Annexure R-1, has been filed on behalf of respondent No.1 in the Registry. The same is taken on record. The relevant paragraph of the said compliance report is reproduced as under:- "5.

That the Tehsildar, Bathinda vide his letter No. 293 RI dated 06-04-2026 reported that on 6-4-2026 he alongwith the police officials and the Bank authorities went to takeover the possession of secured asset. However, on the spot after discussion with the Bank authorities (petitioner) the creditor handed over a cheque amounting to Rs.1.0 crore to the officials of the bank (petitioner) and the bank authorities accepted the same. As both the parties came to the settlement stage duty magistrate kept in abeyance the process of handing over the possession to the bank (petitioner). True translated copy of the statement of the Authorised Officer of the Bank (Petitioner) is annexed as Annexure R-1." 3.

A perusal of aforesaid paragraph No.5 of the compliance affidavit shows that order dated 18.09.2025 passed by the Division Bench of this Court in CWP-27957-2025 has been complied with. 4.

In view of the above, since order dated 18.09.2025 passed by the Division Bench of this Court in CWP-27957-2025, has been complied with, therefore, the present contempt is purged and rule stands discharged. 5.
