Learned counsel representing appellant pointed out that petitioner Naveen had filed anticipatory bail before the Additional Sessions Judge, Bhiwani which was dismissed in default vide order dated 18.10.2025 and against the said order present Criminal Appeal (single) has been preferred. There is nothing on record to show that appellant approached the Court concerned for restoration of said bail application and against the said interlocutory order dated 18.10.2025, present criminal appeal has been preferred.

After arguing for some time, learned counsel for the appellant, at this stage, states that he has instructions to withdraw present criminal appeal as he will approach the competent authority seeking the relief of anticipatory bail and accordingly withdraws the same.
