Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.299 dated 05.11.2023 under Sections 147/148/149/323/324/341/506 of the IPC (Section 325 of the IPC added lateron) registered at Police Station Nathu Sarai, District Sirsa. 2.

On the last date of hearing on 19.12.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "Learned counsel for the petitioner inter alia contends that a perusal of the FIR reveals that neither any specific role nor injury has been attributed to the petitioner; the petitioner came to be nominated as an accused on the basis of a disclosure statement allegedly suffered by one of the coaccused.

CRM-M-63862-2024 (O&M) On a pointed query put to the learned counsel as to whether any proceedings under Section 82 of the Cr.P.C. had been initiated against the petitioner since the occurrence in question took place more than a year back on 05.11.2023, he has categorically replied in the negative."

Learned counsel for the petitioner submits that in compliance of order dated 19.12.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 19.12.2024, is made absolute subject to the conditions laid down in Section 482(2) of BNSS, 2023.
