This is an application for preponing the date of hearing of the main appeal and for disposing off the same in terms of the settlement arrived at between the parties.

Learned counsel for the non-applicant/appellant states that he has no objection if the present application is allowed. 3.
In view thereof, the present application is allowed and the date of hearing of the main appeal is preponed. With the consent of learned counsel for the parties, the main appeal is taken on Board today itself. CM-23019-CII-2024 4.
This is an application for condonation of delay of 37 days in filing the appeal.

For the reasons stated in the application, the same is allowed and the delay of 37 days in filing the appeal is condoned. FAO-6028-2024 6.
Learned counsel for the parties are ad idem that the matter since stands settled between the parties. As per the settlement, respondent No.3 would pay an amount of ₹1,75,000 over and above the amount already awarded by the Motor Accident Claims Tribunal, Nuh (hereinafter referred to as 'the Tribunal') to the appellant as full and final settlement of all the claims. 7.
Learned counsel for respondent No.3 states that respondent No.3 has agreed to pay an amount of ₹1,75,000 over and above the amount of ₹2,15,900 already awarded by the Tribunal. Learned counsel further states that the aforesaid amount would be paid as full and final settlement of all the claims and that a cheque in the name of the appellant would be handed over to him within a period of four weeks from today. 8.
Learned counsel for the appellant states that he has no objection. 9.
In view of the above, the present appeal is disposed off in terms of the settlement and with a direction to respondent No.3 to hand over a cheque in the name of the appellant for an amount of ₹1,75,000 over and above the amount already awarded by the Tribunal within a period of four weeks from today.
