Short reply by way of affidavit of the Deputy Superintendent of Police, Sub Division Khadoor Sahib, Camp at Goindwal Sahib, District Tarn Taran, filed in the Court, is taken on record.

Learned counsel inter alia contends that the petitioner, 72-year-old, has been falsely implicated in the present case. There is non-compliance of Section 103(4) BNSS as the alleged recovery is stated to have been made from the house of the petitioner which was lying closed, however, there was no independent witness and no videography has also been made, besides there being no search warrant was obtained by the Investigating Officer which also makes the alleged recovery itself doubtful. There is no material to connect him with the present case. He is not involved in any other similar case; ready and willing to join the investigation as and when required by the investigating agency and will cooperate. Adjourned to 12.02.2026.

CRM-M-62150-2025 (O&M) -2of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) of BNSS, 2023. However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
