NAMIT KUMAR J. (Oral) Prayer in this petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for directing police department to do fair investigation in FIR No.0320/2024 (Annexure P2), registered at Police Station Julana, District Jind, without any unreasonable delay in making arrest of accused and discover the kidnapped minor daughter of the petitioner.
Status report by way of affidavit of Jitender Singh, Deputy Superintendent of Police, Law and Order, District Jind, has been filed on behalf of respondent - State, wherein it has been stated as under;-
11. That investigation of the case is being conducted by P/SI Ashish Kumar of Police Station Julana. In this case the victim...K daughter of the petitioner has been recovered on 23.12.2024 and on 26.12.2024 the main accused Ravi son of Rohtash, resident of Nandgarh has been arrested and arrest of co-accused Sumit son of Joginder Singh, MOHD YAKUB 2025.01.09 16:52 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh
CRM-M-64020-2024 resident of Sirsa Kheri and Neeraj son of Dharaj, resident of Hatt, district Jind is pending. Sincere and best efforts are being made to locate and arrest the absconding accused. Since fair and impartial investigation of the case is being conducted then the present petition is liable to be dismissed, being devoid of merits.
Learned counsel for the petitioner submits that in view of the stand taken in the status report, the instant petition has been rendered infructuous.
Disposed of as having become infructuous.
