The present petition under Section 528 of BNSS, 2023, has been filed by the petitioner - Gulab, for quashing of order dated 26.11.2010, passed by learned CJM, Palwal (Annexure P-2), in case FIR No.133, dated 29.04.2005, under Sections 279, 337, 338 of IPC, registered at Police Station Sadar, District Palwal, whereby, petitioner had been declared proclaimed offender.

Counsel for the petitioner contends that after registration of FIR, petitioner had been granted bail by the Court and thereupon, he continued joining the proceedings up-till the time, he was declared proclaimed offender. Now the petitioner is again willing to join the proceedings, subject to granting him protection from arrest. 3.

This Court finds that petitioner has not only misused the concession of bail about 14 years back, but thereafter also, he never surrendered himself up-till now, and therefore, this Court does not find any JAWALA RAM 2025.01.24 11:17 I attest to the accuracy and authenticity of this document
