By way of instant petition filed under Section 29-A of the Arbitration and Conciliation Act, 1996 (for short "the Arbitration Act"), petitioner has approached this Court for extension of time by a period of four months to enable the Arbitrator to pass an award. 2.

Counsel for the petitioner submits that by order dated 26.08.2022, Annexure P-1, dispute between the parties was referred for adjudication to a former Judge of this Court. She submits that the learned Arbitrator entered upon the reference, but the proceedings could not conclude within the statutory time frame and on a consensual order dated 31.08.2024, Annexure P-2, passed by this Court, time was extended by a period of four months, which is about to expire.

ARB-637-2024 -23.

Mr. Sharad Aggarwal, DAG, Haryana has placed on record a copy of communication bearing No.1784/B dated 20.12.2024 and states that the respondent had informed the learned Arbitrator that they will not object to the extension of time. This is reflected in procedural order dated 09.12.2024, Annexure P-3. Mr. Aggarwal has instructions to state that the respondents are abiding by their assurance.

In view of the above, petition is allowed. Period for conclusion of the arbitral proceedings and for making the award is extended by a period of four months from 05.01.2025.
