The instant writ petition embodies challenge to the administrative order dated 02.12.2024 (Annexure P-12), whereby, the respondents No.5 and 6 (Sanitation Workers) have been transferred from the petitioner- Gram Panchayat, on account of pending inquiry against them. Vide the said administrative order, two other sanitation workers have also been transferred to the petitioner- Gram Panchayat in place of the respondents No.5 and 6.

The grievance of the petitioner- Gram Panchayat is that, the respondents No.5 and 6 were not properly performing their cleaning duties and were not doing any cleaning work at all, consequence whereof had to be faced by the petitioner- Gram Panchayat. Resultantly, the petitioner-Gram Panchayat made complaint against the respondents No.5 DEVINDER YADAV 2025.05.26 09:47 I attest to the accuracy and authenticity of this order/judgment

CWP-34696-2024 (O&M) and 6 and a specific inquiry report was submitted by the B.D.P.O. concerned on 30.04.2024, thereby recommending their removal from employment. However, despite specific inquiry report, no final action has been taken against the respondents No.5 and 6, rather they have merely been transferred.

This Court has examined the impugned administrative order and does not find any illegality or perversity therein, inasmuch as, the same has been passed for the welfare of the petitioner- Gram Panchayat. Vide the impugned administrative order, not only the errant contractual sanitation workers/respondents No.5 and 6 have been transferred from the petitioner- Gram Panchayat, but, two other sanitation workers have also been deputed there for ensuring cleanliness in the village. 4.

Insofar as petitioner's grievance with regard to no action being taken against the respondents No.5 and 6 is concerned, the petitioner- Gram Panchayat cannot primarily be considered to be aggrieved therefrom. Nonetheless, this Court deems it appropriate to pass directions upon the B.D.P.O. concerned to take the complaint made by the petitioner- Gram Panchayat to a logical end.
