On 26.11.2025, this Court had passed the following order:- "At the outset, learned State counsel, in response to the order dated 17.11.2025, submits that a conjoint reading of Rule 5 (ii), Appendix 'B' of the Punjab Water Supply and Sanitation Junior Engineers (Group-'B') Service Rules, 2017, and the advertisements (Annexure P-12 and P-13), along with the Punjab Water Resources Department, Junior Engineer (Group B) Service Rules, 2021, would make it clear that requirement of 5% reservation has been done away with. Therefore, the impugned advertisements are in consonance with the Services Rules. He further submits that if, at all, the petitioner has any grievance with regard to the issue of reservation, he shall have to challenge the Rules of 2021, at the first instance.

Furthermore, under the Rules of 2021, there is no bifurcation for the cadre of Junior Engineers with respect to their discipline, i.e. Civil, Mechanical and Electrical. Thus, the department concerned and the Selection Board are not required to prepare separate merit lists. However, a request for an adjournment has been made on behalf of learned arguing counsel for the petitioner. Adjourned to 02.12.2025."

Today, learned counsel for the petitioner has fairly acknowledged that there exists a legal difficulty in maintaining the instant writ petition, as the petitioner is required to challenge the Punjab Water Resources Department, Junior Engineer (Group B) Service Rules, 2021 (hereinafter referred to as the "Rules of 2021"), which govern the service. Accordingly, he seeks leave to withdraw the instant writ petition, with liberty to challenge the Rules of 2021.

Consequently, the instant writ petition is dismissed as withdrawn, with liberty (supra).
