NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Article 226 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the order dated 12.09.2023 (Annexure P-10) to the extent of ordering recovery of entire amount of solatium along with exorbitant rate of 12% interest paid as compassionate financial assistance, after 12 years of death of the father of the petitioner, deceased Payara Singh, who died of electrocution on 20.03.1996. Further a writ of mandamus has been sought for restraining the respondents from recovering 75% amount with 12% interest from the salary of the petitioner that too within one year. Further prayer has been made to direct the respondents to refund 25% of the amount of solatium deposited by the petitioner in order to get appointment on compassionate basis. Lastly, it is prayed that respondents be directed to MOHD YAKUB 2024.12.19 17:41 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CWP No.34524 of 2024 grant all the notional benefits of compassionate appointment w.e.f. the date the petitioner became eligible as more than 165 persons were given compassionate appointment during said period as is clear from letter dated 19.06.2012 (Annexure P-7) in lieu of refund of entire amount of solatium ordered to be deposited by the petitioner in order to get appointment on compassionate basis in the year 2023. After arguing the case for some time, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file afresh, on the same cause of action, with better particulars by attaching all the necessary documents.
