On 25.03.2026, the following order was passed by this Court:- "

The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of notice dated 15.09.2025 whereby respondent has ordered recovery of old age pension paid during March' 2013 to April' 2025.

The respondent by impugned order dated 15.09.2025 has ordered to recover old age pension amounting to ₹2,82,150/- along with interest on the ground that petitioner misrepresented his age and received pension during March' 2013 to April' 2025. The petitioner started getting pension in March' 2013. One person named Sourav Kumar lodged complaint along with birth certificate dated 23.10.2023 alleging that petitioner has misrepresented his age. The respondents conducted verification. CWP No.33084-2025(O&M) -229.05.2025 confirmed that Jarnail Singh son of Dal Singh is not resident of their village. The petitioner filed representation dated 12.06.2025 to Deputy Commissioner, Sirsa seeking continuation of pension. As per District Social Welfare Officer, old age pension has been stopped on the basis of School Certificate. Learned counsel for the petitioner submits that petitioner is ready to undergo Ossification Test to vindicate his stand.

Faced with this, learned State counsel submits that petitioner may be directed to appear before Chief Medical Officer, Sirsa on 27.03.2026 and thereafter as determined by said Officer.

In the wake of statement of both sides, the petitioner is directed to appear before Chief Medical Officer, Sirsa on 27.03.2026 at 10:00 AM and thereafter as directed by said officer for Ossification Test. The Chief Medical Officer, Sirsa would directly send his report to this Court.

Adjourned to 06.05.2026."
