On 30.01.2025 the following order was passed : 'Learned counsel for the petitioner would contend that the suit itself was filed only for partition enlisting about 25 properties. On 07.09.2021 an injunction order was passed restraining the petitioner herein from alienating the properties during the pendency of the suit. The learned counsel would further contend that the said order stands till date though the same has been challenged in appeal by the petitioner herein. It is further the contention of the learned counsel for the petitioner that there is no justification for appointment of a receiver especially when the suit itself is not for mesne profits or rendition of accounts.

Today learned counsel appearing on behalf of respondent No.1 states that respondent No.1 would have no objection if operation of the order dated 07.10.2024 (Annexure P-2) passed by the learned Trial Court, appointing a receiver, is stayed during the pendency of the appeal before the learned First Appellate Court.

Learned counsel for respondent No.2 states that respondent No.2 would also have no objection to the same.

Learned counsel appearing on behalf of respondents No.3 to 5 also states that respondents No.3 to 5 would have no objection to the same. 5.

In view of the above, the present revision petition is allowed to the extent that the operation of the order dated 07.10.2024 (P-2) passed by the Trial Court, appointing a receiver, shall remain stayed during the pendency of the appeal challenging the said order (P-2) before the learned First Appellate Court. The learned First Appellate Court is requested to expedite the hearing of the appeal.
