(Oral) Present petition has been preferred under Section 482 of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023 for grant of anticipatory bail to the petitioner in FIR No.625 dated 12.10.2024 under Section 106 of BNS registered at Police Station Kundli, District Sonepat.

A request for joining the Court proceedings through video conferencing was made by learned counsel for the petitioner. However, no one has appeared on his behalf.

Learned counsel for the State assisted by counsel for the complainant submits that offence under Section 105(3) BNS and 304 IPC is added. She further submits that the investigation of the case is at initial stage and during the course of investigation, sufficient evidence have come forth against the petitioner. The petitioner along with the co-accused Neelam had called the deceased along with other children for taking food on the occasion of Durga Navmi and thereafter put the water like substance (acid) in a glass and gave it to the deceased child due to which he died. Learned State counsel submits that as such, the allegations against the petitioner are serious in nature. The custodial interrogation of the petitioner is required to find out and to ascertain the resource of the acid and motive and SONIA BURA 2025.05.02 15:44 I attest to the accuracy and integrity of this document

Having heard learned counsel for the State and perusal of the record and keeping in view the nature of gravity of allegations and the fact that the investigation is at the nascent stage, no ground is made out to grant the anticipatory bail to the petitioner.
