Learned counsel appearing on behalf of the petitioner submits that the alleged recovery of 1 kg 76 grams of "Ganja" was effected solely from co-accused Vinod Singh, and that the petitioner has been nominated as an accused only on the basis of Vinod's disclosure statement and no contraband or any other incriminating material has been recovered from the petitioner. It is further contended that the petitioner has been in custody since 04.08.2025, the investigation already stands concluded, and the charge was framed on 03.11.2025. Moreover, out of the 14 witnesses cited by the prosecution, none has been examined till date and as such the trial is likely to take a long time to conclude.
