Learned counsel would contend that the petitioner had undergone treatment of bypass surgery at Apollo Hospital, New Delhi on 27.12.2023 in emergency, certificate regarding the same was issued by the hospital dated 02.02.2024 appended as Annexure P-1, while that of Civil Surgeon, Hisar dated 16.02.2024, Annexure P-2, however, out of Rs.4,80,413/-, only Rs.52,414/- has been released without there being any justification for withholding the balance amount, regarding which reliance is placed on the judgments of this Court in Raj Kumar Garg vs. Haryana State Agricultural Marketing Board and Others in CWP-4800-2024, decided on 27.09.2024 and Subhash Chander vs. State of Haryana and Another, CWP-8870-2024, decided on 04.12.2024. In this regard, a legal notice dated 01.10.2024, Annexure P-8, has been served upon respondents, but the same has yet not evoked any response. He thus, at this stage, on MOHIT 2024.12.20 12:30 I attest to the accuracy and integrity of this document

instructions from the petitioner prays that a direction is given to the respondents to decide the same keeping in view the aforesaid judgments in a time bound manner. 3. Notice of motion.

3  &Ms. Tanisha Peshawaria, DAG Haryana accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 01.10.2024, taking note of the afore-referred judgments within a period of 3 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon           ! "
