The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondents to keep Departmental proceedings in abeyance till the conclusion of criminal proceedings emanating out of FIR No.16 dated 27.05.2025 under Sections 384 and 120-B of IPC and Section 7, 7-A, 13(1)(b) 13(2) of P.C. Act registered at Police Station Anti Corruption Bureau, Rohtak. 2.
Learned counsel for the petitioner submits that respondents have filed incomplete Police report. Foundation of allegations against petitioner is audio recording. The respondents have obtained voice samples and report of Laboratory is still pending. 3.
Faced with this, learned State Counsel expressed his inability to controvert orders passed by this Court in similar petitions where departmental proceedings are ordered to be kept in abeyance. In the wake of statement of both the sides, the present petition stands disposed of with a direction to respondents to keep departmental proceedings in abeyance till the date of filing of voice sample report in aforesaid FIR.
