(ORAL) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to promote the petitioner to the post of PGT English with effect from 08.01.2021, the date from which her junior Anita Kumari Yadav, seniority no.11841, has been so promoted vide order dated 13.04.2022, Annexure P-8.

Learned State counsel has received instructions from the second respondent vide memo dated 27.04.2026, a copy whereof is retained on the case file along with its enclosures as Annexure 'A'. Referring to the same, she contends that the petitioner has been promoted to the post of PGT English with effect from 13.06.2025 notionally, which is the date wherefrom her juniors have been promoted.

Learned counsel for the petitioner, however, contends that the petitioner has been assigned seniority position 11826-A, as apparent from the promotion order itself, and her junior at seniority position 11841 has already been so promoted with effect from 08.01.2021 notionally, vide the MANINDER 2026.04.29 17:09 I attest to the accuracy and authenticity of this order/judgment

CWP-33221-2025 2 order aforementioned. Accordingly, the petitioner is also entitled to notional promotion from that date, and she may be permitted to make an appropriate representation to that effect bringing all the relevant facts before the second respondent.

Learned State counsel has no objection to the prayer made. 5.

In view thereof, the petition is disposed of permitting the petitioner to make an appropriate representation to the second respondent - Director General, Department of Secondary Education, within two weeks from today, seeking retrospective notional promotion from the date her junior has been promoted, and the same will be decided by the said respondent within three months of receiving the representation. 6.
