After hearing counsel for the petitioners, on 11.11.2025, following order was passed by this Court:- i) Present criminal writ petition has been filed under Articles 226 and 227 of the Constitution of India, read with Section 528 of the BNSS, seeking issuance of appropriate directions to respondents No. 2 and 3 to protect the life and liberty of the petitioners from private respondents.

ii) Petitioner No. 2 - Ishmeet Kaur, aged 17 years, is presently residing with Petitioner No. 1, her maternal grandmother-in-law (Nani saas). Respondent No. 4 is her grandfather, respondent No. 5 is her father, and respondent No. 6 is her aunt.

iii) It has been averred in the petition that respondent No. 5, father of petitioner No. 2, along with other family members, started harassing the mother of petitioner No. 2 for bringing insufficient dowry. On account of such harassment and maltreatment, the mother of petitioner No. 2 was constrained to seek divorce, which was granted in the year 2020. Pursuant to the decree, the custody of the children was divided - son remained with the mother of petitioner No. 2, while petitioner No. 2 remained with respondent No. 5 (father).

It is further pleaded that respondent No. 5 is an alcoholic and used to maltreat petitioner No. 2.

Despite her being a minor, he is allegedly forcing her to marry an elderly man aged about 45 years in lieu of money.

Since petitioner No. 2 has been constrained to stay with petitioner No. 1, she apprehends danger to her life at the hands of her own family members. Hence, present petition has been filed.

iv) Notice of motion for 21.11.2025.

v) Mr. Neeraj Madaan, learned Senior Deputy Advocate General, Punjab, appears on behalf of the respondent/State and seeks some time to file a status report.

vi) Let Senior Superintendent of Police, Sangrur, depute a responsible police officer not below the rank of Inspector to visit the place where the petitioners are residing and ensure that their statements are recorded freely, without any threat or coercion.

vii) To be shown in the urgent list."

Today, learned State counsel has filed status report dated 20.11.2025 in the Court today and the same is taken on record. Registry is directed to tag the same at the appropriate place on the file. 3.

Learned State counsel reads out paragraph No.5 of the status report, to clarify the steps that have been taken with respect to providing protection to the petitioners.

Paragraph Nos.5 and 8 of the status report are reproduced here under:- "5.

That it was further verified that regarding the disappearance of petitioner No.2, FIR No.121 dated 04.06.2025 under Sections 363, 366-A and 120B IPC already stands registered at Police Station Lehra, District Sangrur against unknown.

During the investigation of the said FIR, challan has been presented against accused Veerpal Kaur (behind bars) and Krishan Singh who is on bail. The arrest of accused Charanjit Kaur and Pal Kaur is still pending and multiple efforts including raids to apprehend them are underway. The petitioners have expressed apprehension of threat from the private respondents in connection with the said proceedings also.

That in view of the threat perception expressed by the petitioners during the enquiry and in order to prevent any untoward incident, preventive action has been taken vide DDR No.22 dated 18.11.2025 under Sections 126/169 BNSS Police Station Lehra against

the concerned persons, namely Iqbal Singh, Karnail Singh, Mandeep Singh and Rupinder Kaur, all residents of village Ladal, Police Station Lehra, District Sangrur. The local police has been directed to maintain vigilance and to take immediate action in case of any reported threat. The petitioners have also been advised to approach the undersigned or the local police authorities without delay if any such situation arises. A copy of the said DDR is annexed as Annexure R-3.

That in view of the directions issued by this Hon'ble Court and the preventive steps already taken by the local police, no further immediate action is required at this stage, and the petitioners have been advised to report forthwith to the Station House Officer, Police Station Lehra, or to the undersigned, in case of any threat or occurrence."

Counsel for the petitioners submits that since the requisite steps, i.e. registration of DDR No.22 dated 18.11.2025 under Sections 126/169 of the BNS at Police Station Lehra, along with measures to ensure the safety and security of the petitioners, have already been taken by the State, he does not wish to press the present petition, at this stage. 6.

In view of the explanation provided by learned State counsel in the status report, and in light of the statement made by counsel for the petitioners, this Court finds no reason to issue any specific direction to the respondents, at this juncture.

Accordingly, present petition stands disposed of, being not pressed, at this stage.
