1.1 A further challenge has been made to the order dated 27.10.2025 (Annexure P-7) passed by the learned Divisional Commissioner, Hisar, whereby the revision petition filed by the petitioners against the aforesaid order dated 14.08.2025 (Annexure P-5), has been dismissed. 2.
During the course of hearing, the petitioners and respondent No.6 (petitioners No.1 to 3 and respondent No.6 being present in Court and duly identified by their respective counsel), have arrived at an amicable settlement with regard to the areas respectively allocated to them in the partition proceedings, and also regarding the shifting of the passage provided in the land under partition, based upon the site plan (Annexure P-11) as extracted below:- 2.1 In the above extracted site plan, the parties have admitted that the area depicted in pink colour has been allocated to respondent No.6, whereas the remaining area has been given to the petitioners.

The petitioners and respondent No.6 have arrived at an amicable settlement on the following terms:- (i) In the above extracted site plan, a passage (referred to as the 'existing passage') has been provided during the partition proceedings to approach the petitioners' land. The said passage (2 Karams wide), falls towards the eastern side of Killa Nos.179//13/1 and 179//18/2, and has been assigned Killa numbers as 179//13/2 and 179//18/1. It has been mutually agreed between the parties that in lieu of the aforesaid 'existing passage' (2 Karams in width), a new passage with 2 Karam width (as indicated in the above extracted site plan), shall be provided from the western side of Killa Nos.179//13/1 and 179//18/2.
Upon provisioning of the new passage, the existing passage shall be included in the respective areas of the parties from whose land the said existing passage was earlier passing. It has also been mutually agreed that on account of shifting of the aforesaid passage from the eastern side towards the western side, if any new killa number is to be assigned to the new passage or the adjoining area by the Revenue Authorities then they shall have no objection to the same. (ii) Respondent No.6 has agreed to leave an area measuring 12 Marlas from Killa No.179//13/1 (indicated as point 'A' in the above extracted site plan) and the said 12 Marlas shall be included in the petitioners' area. The said 12 Marla area shall be allocated to the petitioners just adjoining the killa line bifurcating Killa Nos.179//13/1 and 179//18/2.
12 Marlas to respondent No.6 from Killa Nos.244//20/3. The said 12 Marla area shall be allocated to respondent No.6 just adjoining and touching the other area of respondent No.6 in Killa No.244//11 and 20/2 (shown in pink colour and marked as point 'B' in the site plan). The said 12 Marlas to be transferred by the petitioners to respondent No.6 shall be allocated parallel to the killa line bifurcating Killa Nos.244//20/2 and 244//20/3. (iii) The parties have mutually agreed to get the aforesaid changes incorporated in the partition papers in consonance with the settlement arrived at between them before this Court. 4.
Keeping in view the broad consensus arrived at between the parties, as indicated above, the present writ petition is disposed of, accordingly.

Parties may appear before the learned Assistant Collector, IInd Grade, Hisar, along with a copy of this order, with a request to effect changes in the partition papers in accordance with the settlement arrived at between the parties, as indicated above, and to finalize the partition proceedings accordingly.

All pending application(s), if any, shall also stand closed. 7.
A colored print out of this order be given to all concerned parties.
