The present petition has been filed by the petitioner under Section 482 of BNSS, 2023 for anticipatory bail in case bearing FIR No.107 dated 24.07.2025, registered under Sections 419, 420, 467, 171, 120-B IPC, at Police Station Dera Baba Nanak.

The facts of the present case are that the present FIR has been lodged by complainant Balkar Singh who stated therein that his real brother Arjan Singh died 40/45 years ago, and the complainant had been cultivating the land of his brother Arjan Singh measuring 7 Kanals 19 Marlas situated at village Paracha. On 28.05.2024, one Sukhdev Singh is alleged to have fabricated deceased Arjan Singh's Aadhar Card and made a forged Aadhar Card, and used the same to transfer the ownership of said land in the name of his son-in-law, namely, Malkiat Singh (present petitioner), vide Vasika No.2024-25/148/1/257 from the office of Sub Registrar Dera Baba Nanak.

CRM-M-63184-2025 -2Thereafter, aforesaid Sukhdev Singh alongwith his son-in-law Malkiat Singh and other unknown persons, forcibly tried to plough the said land and plant paddy at night, which was stopped with the help of the police. Hence the aforesaid FIR has been registered against the petitioner and other co-accused.. 3.

Learned counsel for the petitioner contended that the petitioner was not known to Arjan Singh, and he did not play any role in fabrication or manufacturing of alleged Aadhar Card of Arjan Singh, if any, used at the time of registration of sale deed dated 28.05.2024 in the office of Sub-Registrar concerned. It is further contended that the petitioner has been falsely implicated in the present case, and claimed to be the bona fide purchaser of the land by way of payment of Rs.12 lac as consideration, in cash. 4.

On the other hand, learned counsel for the State opposes the grant of concession of anticipatory bail to the petitioner by submitting that the present petitioner is the son-in-law of the main accused-Sukhdev Singh, and is the beneficiary of the aforesaid forgery of Aadhar Card, and consequent transfer of land in his name.

This Court has heard learned counsel for both the parties and has considered the allegations made against the petitioner. Since the petitioner is the beneficiary of the sale deed dated 28.05.2024 and his father-in-law is alleged to have impersonated as the deceased Arjan Singh, brother of the complainant; it is a case of fraud by way of impersonating the deceased and transferring of land in question, the custodial interrogation of the petitioner is required to unravel the truth. Moreover, the investigation is still going on, therefore the allegations made against the petitioner are serious in nature and therefore, the petitioner does not deserve the concession of anticipatory bail.

In view of above, this Court finds no ground to grant the concession of anticipatory bail to the petitioner. Therefore, the present petition stands dismissed.
