Seeking grant of blanket bail for two weeks, in case FIR is registered against the petitioners in the police station of respondents No.2 to 4, petitioners have come up before this Court by filing the present petition under Section 482 r/w 528 BNSS 2023. 2.

Notice served upon the official respondent(s) through State counsel. 3.

Counsel for the State opposes the relief as prayed in the present petition. Counsel for the State submits that petitioner is not even joining the inquiry. Even this Court is of the opinion that blanket bail cannot be given unless it falls under exceptional circumstances as laid down by the Constitutional Benches of Hon'ble Supreme Court of India.

Petitioners' counsel submits that he would be contended and satisfied if an FIR ultimately is registered based on inquiry which is annexed at Annexure P-2, they be given notice in case investigator wants to arrest them. 5.

Given above, provided the petitioner joins the inquiry as and when called upon to do so and in case, such inquiry results into registration of FIR, investigator will give them three days notice in advance if he wants to arrest them. Petition is disposed of with the aforesaid observation. It is clarified that in case the petitioners are called to join inquiry and they fail to do so (without any justiciable cause which will be conveyed to the investigator) then the present order regarding three days notice shall stand vacated without any further reference to this Court.
