Punjab 77777 Petitioner has filed instant petition under Section 482 of +.&2"6&8 /&8. .49 for grant of anticipatory bail in FIR No.160 dated 18.11.2024 under Sections 115 (2), 118 (1), 3 (5), 76 of BNS (Annexure P-1) (Section 117 (2) BNS was added later-on vide DDR No.11 dated 24.11.2024) registered at Police Station Subhanpur, District Kapurthala.

Learned counsel for petitioner argued that arrest of petitioner was stayed vide order dated 07.01.2025 and relevant portion thereof runs as under:- "............................................. Learned counsel for petitioner denied the allegations. It is pointed out that false FIR has been registered due to previous enmity. Coaccused Guriqbal Singh alias Happy has been granted
anticipatory bail by the Court of learned Additional Sessions JudgeI, Kapurthala vide order dated 19.12.2024. Present petitioner is also ready to join investigation and hand over alleged weapon of offence i.e. Sota to Investigating Agency.

On asking of this Court, Mr. Siddharth Sandhu, AAG, Punjab accepts notice on behalf of State and prays for an adjournment to file detailed status report.
I have considered the contents of FIR. Let detailed status report be filed by respondent-State on or before next date of hearing.

In the meantime, arrest of present petitioner is stayed subject to joining of investigation as referred above, till next date of hearing."

Learned counsel for petitioner submits that petitioner has joined the investigation in terms of aforesaid order. He has fully cooperated in investigation. Alleged weapon of offence i.e. Sota has also been recovered. He is still ready to abide by the terms of bail order. Therefore, anticipatory bail application may be allowed. 4.
Status report is filed confirming the fact that present petitioner has joined investigation on 15.01.2025 and he fully cooperated. No further recovery is to be effected from him. He is not required for further investigation.

I have considered the aforesaid factual position. Since petitioner has joined investigation in pursuance of order dated 07.01.2025, no purpose would be served by sending petitioner behind the bars. He is still ready to join investigation as and when required. Considering the aforesaid factual position, anticipatory bail filed by petitioner is allowed.
9 He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.
