Occurrence in the present case took place on 11.04.2025 and thereafter, the FIR was registered on 12.04.2025. As per the allegations in the FIR, a shot was fired by the named accused, namely, Sunny Bhalwan, who was accompanied by other coaccused, including the petitioner, as disclosed in the disclosure statement of the main accused - Sunny Bhalwan.

Statement of the victim - Arbaaz Khan, is yet to be recorded. Accordingly, the instant petition is disposed of with a direction to the learned trial Court to get the statement of the aforesaid victim recorded at the first instance, and thereafter, it would be open for the petitioner to move a fresh petition on the same cause of action before this Court.
