Mr. HS Deol, Sr. Deputy Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner apprehends his arrest in respect of the offences punishable under Sections 105 and 61(2) of the Bharatiya Nyaya Sanhita2023 and Sections 15, 18, 20, 21, 22, 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 in FIR No. 51 dated 19.09.2024 registered at Police Station Bakhshiwala, District Patiala. 2.

The only allegation against the petitioner is of selling narcotic drugs in the village but no recovery has been made. The investigation is still pending.

As per the State counsel, the petitioner has suffered about four convictions under the NDPS Act and another FIR of similar nature has been registered in the year 2021 which is pending at the stage of trial. 4.

The petitioner has criminal antecedents of having involved in the offences of similar nature and is alleged with the offence of sale of narcotic drugs though no recovery of narcotic drug has been made from petitioner and it is informed by learned counsel for the petitioner that RAVINDER KUMAR 2024.12.20 19:48 I attest to the accuracy and integrity of this document

CRM-M No. 64805 of 2024 (O&M) [2] similarly placed co-accused have been extended the benefit of anticipatory bail.

Since possibility of recovery in a case of sale of narcotic drugs may or may not take place in every case, but considering the fact of criminal antecedents of the petitioner of having been convicted in four offences, this Court declines the prayer for grant of interim anticipatory bail to the petitioner.
