Seeking setting aside of order dated 22.04.2025 passed by respondent No.1 vide which claim of petitioner for premature release was rejected, the petitioner has come up before this Court by filing the present petition under Article 226 of the Constitution of India.

Counsel for the petitioner submits that the petitioner would be contended and satisfied if pre-mature release of the petitioner is re-considered in terms of judgment of Hon'ble Supreme Court passed in Special Leave Petition (Crl.) No. 8539 of 2025 titled 'Anil Kumar @ Lapetu Ramshakal Sharma v/s The State of Maharashtra and others" and also keeping in view Annexure P-3, the judgment passed by a Co-ordinate Bench of this Court.

Given above, the present petition is disposed of with a direction to the concerned authorities to re-consider the case of the petitioner for premature release strictly in the light of judgment of Hon'ble Supreme Court and decide the same within a period of one month and also keeping in mind the order (Annexure P-3) passed by a Co-ordinate Bench of this Court. Petitioner is also permitted to file fresh application annexing the copy of the judgment and also Annexure P-3. The order so passed be also communicated to the petitioner without any delay.
