***** SANJEEV PRAKASH SHARMA, J.(Oral) Admittedly, respondent No.1 had been granted disability pension on the recommendation of the Medical Board and was getting the same @ 20% from 01.05.1991 to 31.05.2001 whereafter the writ petitioners stopped his disability pension. The Armed Forces Tribunal has directed for constituting Re-Survey Medical Board and accordingly to take decision and release the arrears restricted to 03 years.

The UOI is assailing the said order before us submitting that after 2001, respondent No.1 never demanded the Re-Survey Medical Board. 3.

We find the arguments to be without any basis and find that the claim of respondent No.1 has been limited to period of 03 years alone which would cover the limitation period.
