On 12.11.2025, the following order was passed by this Court:- 1.

The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to consider his son for compassionate appointment as per orders dated 03.08.2015 of the Cabinet of Government of Punjab.

2. The petitioner joined Punjab Police Force as Constable (Probationer) on 09.02.1992. On 27.07.2015 at about 05:15 AM, terrorists from Pakistan came to Dinanagar, District Gurdaspur in Army Uniform. They snatched a Maruti car and attacked Police Station, Dinanagar. The petitioner along with other Policemen reached at Police Station and bravely faced terrorists. He was injured in the encounter. He suffered 30% permanent

CWP No. 33485 of 2025 -2disability. He was awarded Parakram Padak along with Rs.50,000/- vide letter dated 28.08.2015.

Learned counsel for the petitioner submits that Council of Ministers in its meeting held on 03.08.2015 approved proposal of Additional Chief Secretary, Department of Home whereby employees who had participated in terrorist attack were ordered to be granted additional benefits. It was decided that employees injured during this incident would be promoted and they will get their entire treatment free of cost. The petitioner was assured that his one family member would be considered for Government Job on compassionate ground. He submitted requisite documents to SSP, Pathankot for employment of his daughter. SSP, Pathankot forwarded his request to DGP. SSP Pathankot after 9 years took up the matter and sent letter dated 30.09.2024 to DIG recommending appointment of petitioner's son Abhishek. SSP, Pathankot pursued the matter with DGP.

The petitioner and SSP, Pathankot met IG (Headquarters) on 07.01.2025 and submitted requisite documents. The petitioner was assured of recruitment of his son. The DGP vide letter dated 31.01.2025 asked SSP, Pathankot to clarify whether petitioner or his family had already availed benefit. SSP, Pathankot vide letter dated 06.03.2025 confirmed that petitioner has not availed any benefit. IG (Headquarters) vide communication dated 01.04.2025 rejected petitioner's claim on the grounds that in the past, many appointments had been wrongly made. No further job can be given on such grounds. The respondent despite rejecting petitioner's claim has promoted one Inspector to the rank of DSP on 15.08.2025.

4. Learned counsel for the petitioner seeks time to ascertain whether benefit of compassionate appointment

CWP No. 33485 of 2025 -3was granted to any other police official who was injured in the aforesaid incident.

Learned State counsel during the course of hearing submitted that Director General of Police has filed affidavit before this Court in CWP No. 22174 of 2018 deposing that no such appointment as claimed by petitioner herein would be made in future.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to file afresh with better particulars.
