MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.153 dated 15.11.2024 under Sections 420, 120-B of the Indian Penal Code, 1860, registered at Police Station Division No.2, Pathankot.

On 21.01.2025, following submissions of learned counsel for the petitioner were recorded:- "Learned counsel for the petitioner submits that even as per complainant's own case, petitioner had sold the land in question out of his own share; there were no specific allegations against the petitioner and the FIR does not reveal the commission of any cognizable offence. A mere allegation that petitioner's brothers were interfering in the land, more so when no partition had taken place, was not sufficient to attract the mischief of offences under Sections 420 and 120-B of the IPC."

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 06.03.2025 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
