BHARDWAJ, J (ORAL) The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for seeking quashing of FIR bearing No.94 dated 05.10.2023, under Section(s) 341, 323, 427, 148 and 149 of the Indian Penal Code, 1860, registered at Police Station Bhargo Camp, District Jalandhar, along with all the consequential proceedings arising therefrom on the basis of compromise dated 08.10.2025 arrived at between the affected parties.
Vide order dated 13.11.2025, the parties were directed to appear before the Illaqa Magistrate/trial Court to get their RAJ KUMAR ARORA 2026.05.25 18:43 I attest to the accuracy and integrity of this document statements recorded and a report was also called for from the trial Court.
CRM-M-63877-2025 (O&M) -2Vide Memo No.580 dated 19.12.2025, it has been reported by the Chief Judicial Magistrate (NRI Court), Jalandhar, that neither the complainant nor the accused appeared to get their statements recorded regarding the compromise. Accordingly, vide order dated 04.02.2026, the parties were again afforded an opportunity to get their statements recorded in terms of the compromise. However, vide Memo No.80 dated 09.03.2026, it has been reported by the Chief Judicial Magistrate, Jalandhar, that neither the affected parties-respondents No.2 to 4 nor accusedpetitioners have appeared to get their statements recorded in support of the settlement. The petition is pending since January 2025. Since the present petition was filed solely on the basis of compromise arrived at between the parties, however, on account of failure of the affected parties to appear before the trial Court on two occasions pursuant to the orders passed by this Court, no further indulgence is warranted, at this stage.
Present petition is accordingly dismissed at this stage. The parties shall, however, be at liberty to file a fresh petition as and when the matter is amicably resolved between them. May 22, 2026.
