(ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.764 dated 27.09.2023 registered under Sections 406, 420, 467, 468, 471, 120-B of the IPC at Police Station City Hansi, Police District Hansi, District Hisar.

Vide order dated 31.12.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present FIR. He further contends that the name of the petitioner has been surfaced only on the basis of disclosure statement made by coaccused Ashok Kumar and even as per the investigation, the alleged amount has been stated to be received by other four coaccused and the petitioner is not the beneficiary. He further contends that the petitioner is ready to join the investigation." 3.

Reply by way of affidavit of Deputy Superintendent of Police, Hansi, District Hisar, has been filed in Court, which is taken on record.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 31.12.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
