***** ARCHANA PURI, J. (ORAL) At this stage, counsel for the applicant, has given a statement on behalf of the applicant that he shall not interfere in the possession of the respondent, in the house, which forms the basis of the suit, copy whereof is Annexure A-2. He further submits that he is making this statement, without any prejudice to the rights of the parties, to be adjudicated in any other pending litigation, relating to the matrimonial dispute of the applicant, with her husband, namely, Amit Jangra i.e. son of the respondent. Counsel also made a statement that the applicant shall withdraw the appeal i.e. SONU 2026.02.16 09:13 I attest to the accuracy and authenticity of this document

TA-1-2025 CMA/57/2024, which is pending before learned Additional District Judge, Hisar, on the date fixed before the Court.

In the light of the aforesaid, counsel for the respondent also gives an undertaking on behalf of the respondent, who is father-in-law of the applicant, that the requisite suit shall be withdrawn by the respondent before the learned trial Court on 20.02.2026 i.e. the date fixed, in view of the statement so made by the counsel for the applicant. In view of the undertaking given by the counsel for the respondent, at this stage, counsel for the applicant submits that he does not want to pursue with the transfer application and the same be dismissed as withdrawn.

Ordered accordingly.

However, the parties shall remain bound by the statements, given by their counsel.
