This petition has been filed under 482 of BNSS, 2023, seeking anticipatory bail in case FIR No.334, dated 06.12.2024, registered under Sections 417, 465, 467, 468 and 471 IPC, at Police Station City Ratia, District Fatehabad.

On 02.01.2025, the following order was passed:- "XX XX XX XX Learned counsel for the petitioner, in asking for the relief (supra) inter alia submits that till date the prosecution is not having any evidence to substantiate the allegations of the complainant to the effect that the cheque in question and other bills, are result of forged and fabrication.

Notice of motion.

Mr. Rajesh Gaur, Addl.A.G., Haryana, accepts notice on behalf of respondent-State, and waives service. Adjourned to 03.02.2025.

In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) of the B.N.S.S., 2023."

Learned counsel for the petitioner submits that there is a delay of 08 months in registration of the FIR (supra) and further the petitioner was working as an Accountant and he resigned from his job on 31.03.2024 and the amount as alleged has been transferred to various accounts after his resignation and further the amount of Rs.30,000/- has been transferred to the account of the petitioner and he is not the beneficiary and the entire case of the prosecution is based upon documentary evidence.

Learned State counsel assisted by learned counsel for the complainant, has filed status report by way of affidavit of Sanjay Kumar, Deputy Superintendent of Police, Rati, District Fatehabad, which is taken on record and he, on instructions from ASI Amar Singh, informs the Court that although the petitioner has joined the investigation but he is not cooperating.

In view of the above and finding that no reason is assigned by learned State counsel as well as learned counsel for the complainant,

qua non-cooperation of the petitioner, order dated 02.01.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973).

The petition stands disposed of.
