The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.0011, dated 08.04.2024, under Sections 406, 420, 120-B IPC and Section 24 of Emigration Act, registered at Police Station NRI, District Gurdaspur. 2.

On 09.03.2026, this Court had passed the following order:- "Learned counsel inter alia contends that the firm of the petitioner and co-accused Iqbal Singh namely M/s All Immigration IELTS and PTE Coaching Centre at Batala, received an amount of Rs.16 lacs odd, which was transferred by the said firm to co-accused Hardeep Singh Valha son of Harbhan Singh r/o Glory Machine Sangatpura, Phagwara and Karan Verma son of Rajesh Verma @ Dr. Rakesh Bhagatpura, r/o Gali No.3, Phagwara, who are the travel agents and Rs.9 lacs has been returned by the aforesaid coaccused Iqbal Singh, has been granted anticipatory bail by the learned Sessions Judge, Gurdaspur vide order dated 28.05.2024, Annexure P-6. The petitioner is involved in 1 more case, wherein the allegations are similar but this Court had dismissed his petition on 15.09.

2025 bearing CRM-M-47191-2025, against which SLP (Crl.)-66144- 2025 was filed, wherein his arrest has been stayed vide order dated 19.01.2026, Annexure P-7, subject to condition that he would cooperate with the investigating agency. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

Learned State counsel as well as learned counsel for respondent No.2 made their respective submissions in opposition. Accordingly, the petitioner is directed to join the investigation on or before 16.03.2026. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482 (2) BNSS.

CRM-M-64511-2025 (O&M) -2- However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from ASI Satnam Singh affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. He also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 09.03.2026 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
