Present petition has been filed by the petitioner under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, for issuance of a direction to the Court of learned Additional Sessions Judge, Kapurthala, for expeditious disposal of the trial in case FIR No.131, dated 17.06.2021, registered under Sections 452, 323, ,324, 427, 148, 149 of IPC, wherein offence under Sections 450, 307 of IPC and Sections 25/27 of Arms Act, 1959, were added later on, at Police Station Sadar, Kapurthala. 2.

Learned counsel for the petitioner contended that the petitioner is in custody for about last 4 years; charges have been framed on 22.01.2025; and for the last about 10 months, no witness has been examined, but, the case was adjourned again and again.

Having heard learned counsel for the petitioner, as the petitioner is in custody for the last about 4 years, and in view of the zimni orders annexed with the petitioner, the instant petition stands disposed of with a direction to the Trial Court to make sincere efforts to conclude the trial expeditiously as for the last 10 months, no witness has been examined till date.
