The instant petition has been filed under Section 483 of BNSS, 2023, for grant of interim regular bail to the petitioner to attend the marriage ceremony of his sister, namely; Shaindeep Kaur, which is fixed for 25.11.2025, in case FIR No. 36, dated 05.07.2025, under Section(s) 21/25/29 of NDPS Act, registered at P.S. State Special Operation Cell, District Amritsar.

On 17.11.2025, following order was passed by this Court:- "1. The instant petition has been filed under Section 483 of BNSS, 2023, for grant of interim regular bail to the petitioner to attend the marriage ceremony of his sister, namely; Shaindeep Kaur, which is fixed for 25.11.2025, in case FIR No. 36, dated 05.07.2025, under Section(s) 21/25/29 of NDPS Act, registered at P.S. Special Operation Cell, District Amritsar. 2.

Notice of motion.

On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance, and accepts notice for the respondent-State and submits that apart the instant case, there is one more case registered against the petitioner, i.e., FIR No.54, dated 08.03.2025,

under Section 21 of NDPS Act, registered at P.S. Sohana.

Adjourned to 21.11.2025.

Let the factum of marriage, as pleaded by the petitioner, be verified by the respondent-State. Apart from this, it shall also be verified as to who else are the family members, including other brothers and sisters of 'Shaindeep Kaur', whose marriage is stated to be fixed for 25.11.2025. Besides, credentials and antecedents of the petitioner shall also be incorporated in the said report.

Today, learned State counsel has filed status report dated 20.11.2025 in the Court today and the same is taken on record. Registry is directed to tag the same at the appropriate place on the file. 4.

Counsel for the petitioner contends that petitioner's mother has already passed away and petitioner's brother is currently lodged in Goindwal Jail.

In addition, statement of Mangal Singh (petitioner's father), appended to the status report, indicates that father of the petitioner is suffering from paralysis and diabetes.

With respect to verification of the facts narrated in the present petition, learned State counsel submits that it has been confirmed that marriage of the petitioner's sister has been fixed for 25.11.2025 with Ravinder Singh, son of Sukhdev Singh, resident of Shekhupur Kalan, Batala, at Bal Palace, Fatehgarh Churian Road, Amritsar. The Shagun ceremony is scheduled for 24.11.2025 at Amrit Palace near Pakharpur, Amritsar.

Paragraph No.4 of the status report reads as under:- "4.

That as per the verification report submitted by ASI Manjinder Singh of Counter Intelligence

Amritsar, marriage of Shaindeep Kaur (21 years) sister of the applicant/appellant Shubhkarmanjeet Singh has been fixed with Ravinder Singh s/o Sukhdev Singh r/o Shekhupur Kalan, Batala. The shagun ceremony is to be organized on 24.11.2025 at Amrit Palace Near Pakharpur, Amritsar, the wedding ceremony is to be held on 25.11.2025 at Bal Palace, Fatehgarh Churian road, Amritsar. During verification of the family members, it has revealed that Shaindeep Kaur's mother Charanjit Kaur passed away about 1 1⁄2 years ago. She has one younger sister namely Palakdeep Kaur (20 years) and one brother namely Shubhkarmanjeet Singh (currently lodged in Goindwal jail). The statements recorded in this respect of Mangal Singh father of the appellant, Numberdar Surjit Singh., Sukhwinder Singh Manager of Bal Palace, Amritsar, Gurmit Singh Granthi of Gurudwara Baba Deep Singh, village Nangli, Fatehgarh Churian road, Amritsar are annexed herewith as Annexure A1 to A4 for kind perusal of this Hon'ble High Court." 8.

Considering the circumstances, and noticing the fact that there is no one in the petitioner's family who is physically able to manage the necessary arrangements, except of his ailing, disabled father and his younger sister whose marriage is to be performed, this Court deems it appropriate to consider the petitioner's plea for interim bail for a period of two days. Accordingly, present petition is allowed. 9.

Therefore, petitioner namely Shubhkarmanjeet Singh is ordered to be released on interim bail, w.e.f. 24.11.2025 to 26.11.2025 till 10.00 A.M., subject to his furnishing two sureties of heavy amount from the same village, to the satisfaction of the learned trial Court/ Chief

Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

However, it is clarified that petitioner would surrender back to the concerned jail authorities on 26.11.2025 at 10.00 A.M.

Let the present petition be listed on 27.11.2025, in order to confirm the factum of the petitioner having surrendered back to the jail authorities.
