This petition has been filed under Section 528 of BNSS for setting aside the impugned order dated 20.04.2024 passed by ld. JMIC, Mukerian District Hoshiarpur in complaint case bearing No. NACT 100-2021 under Section 138 of Negotiable Instruments Act, 1881 titled as "Gurdev Singh Vs. Vijay Kumar" instituted on 06.09.2021 whereby the petitioner has been declared as proclaimed person.

Learned counsel for the petitioner submits that the petitioner was declared as proclaimed person due to his non-appearance. He submits that the petitioner never received any process from the Court and had no knowledge regarding the complaint. He submits that the impugned order dated 20.04.2024 declaring the petitioner a proclaimed person deserves to be set aside. The petitioner is willing to join the proceedings before the Court. 3.

On the asking of the Court, Mr. Rishabh Singla, AAG, Punjab accepts notice on behalf of the respondent-State. 5.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere with the impugned order dated 20.04.2024 passed by ld. JMIC, Mukerian District Hoshiarpur. However, in case the petitioner surrenders before the learned trial Court within the next seven working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the learned trial Court within a period of three days.

Petition stands disposed of in above terms.
