The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of inquiry initiated by DGP-respondent No.2 against him. 2.

As per petitioner, he is posted as Senior Medical officer, CHC Ramdas, District Amritsar. On the basis of complaint of Amandeep Kaur respondent No.4 an FIR No.213 dated 23.07.2021 under Sections 323, 324, 326, 452, 34 IPC was registered against respondent No.5, 6 and

7. The petitioner on 04.03.2021 medically examined Amandeep Kaurrespondent No.4 with respect to two injuries. He prepared Medico Legal Report. The accused in aforesaid FIR filed multiple applications before Higher Authorities seeking fair and impartial investigation. On the basis of their applications, matter was investigated by a team of doctors comprising Dr. Amarjeet Singh, Assistant Civil Surgeon, Amritsar; Dr.

-2Ashish Sharma, M.O. (Forensic) Civil Hospital, Amritsar and Dr. Suneel Mahajan, MO (Ortho), Civil Hospital, Amritsar. The Medical Board involved vide report dated 27.04.2022 exonerated the petitioner. Jarnail Singh-respondent No.5 again started pursuing his complaints. On the basis of his complaints, Punjab Medical Council initiated inquiry against him. He filed reply before inquiry officer. On the basis of petitioner's reply, Board of Investigators comprising Dr. Neelam, District Welfare Officer, Amritsar; Dr. Bharti Pawan, District Vaccine Officer, Amritsar and Dr. Rajender Pal Kaur, Assistant Civil Surgeon, Amritsar dropped the inquiry. Despite, aforesaid two inquires, DGP on the application of respondent has initiated fresh inquiry. It is apt to mention here that police after completing investigation in aforesaid FIR has filed cancellation report. The complainant has filed protest petition and matter is pending before learned trial Court at Amritsar.

Learned counsel for the petitioner submits that respondent has not issued any notice or summons. The police authorities are orally calling him. He has tendered his statement and further sent through email. 4.

Learned State counsel, on instructions from Inspector Shamsher Singh, SHO PS Kamboa, submits that no inquiry qua aforesaid incident is pending before DGP. The petitioner was neither called nor would be called in future with respect to FIR No.213 dated 23.07.2021, however, there are complaints against him with respect to his Scheduled Caste Certificate (for short 'SC Certificate'). The authorities have right to inquire into his SC Certificate.

Faced with this, learned counsel for the petitioner submits that petitioner cannot oppose inquiry with respect to his SC Certificate. 6.

In the wake of statement of both sides, the petition stands disposed of 7.
