Learned counsel for the petitioner submits that the learned Trial Court condoned the delay without issuing any notice to the petitioner and passed the impugned order without affording due opportunity of hearing to the petitioner.

Mr. Manuj Nagrath, Advocate, has appeared and filed his Vakalatnama on behalf of the respondent, which is taken on record. He further submits that he has no objection if the matter is remanded back to the learned Trial Court for being decided afresh on the application for condonation of delay.

Keeping in view the aforesaid facts and circumstances of the case, as well as the statement made by the learned counsel for the respondent, the impugned order dated 06.09.2025 (Annexure P-7) is hereby quashed. The matter is remanded back to the learned Trial Court for deciding afresh the application for condonation of delay, in accordance with law. 4.
