The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No.2 to reconstruct file of FIR No.24 dated 29.01.2005 registered under Section 406, 498A IPC at Police Station Sadar Jalandhar. He is further seeking direction to respondents No.3 and 4 not to arrest him in the event of his arrival in India during the re-construction of abovementioned case file.

On the asking of this Court, ld. District and Sessions Judge Jalandhar has submitted his report disclosing that petitioner was never declared proclaimed offender. File has been misplaced. The papers/documents regarding issuance of non-bailable warrants qua petitioner could not be traced and same are missing. On 06.02.2026, a statement was made by counsel for the petitioner that petitioner plans to come to India in the first week of March. He would appear before the Court concerned within one week from his arrival. Arrest of the petitioner was stayed till 10.03.2026. 4.

Learned counsel for the petitioner submits that on account of ongoing war between USA and Iran, the petitioner had to cancel his plan to visit India. He has rescheduled his visit and would come to India on 20.04.2026. He will appear before trial Court and his arrest may be stayed till 27.04.2026.

Learned State counsel does not oppose aforesaid prayer. 6.

In the wake of statement of both sides, the petition stands disposed of with liberty to petitioner to appear before trial Court on or before 27.04.2026. He would not be arrested till the aforesaid last date of appearance before trial Court.
