The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent bank to disburse arrears of pension of his deceased father. 2.

Father of petitioner (Mr. Madan Lal) retired from Punjab Police and passed away on 04.10.2022. He was a pensioner. He executed registered Will regarding his movable and immovable properties. A sum of approximately Rs.20,00,000/- was lying in his various accounts. The petitioner was nominee of his father in Bank Account No.635212100019064. The Bank of India transferred a sum of Rs.15,50,080/- in his account after death of his father. The petitioner requested respondent to disburse arrears of pension of his father in view of registered Will executed by his father. The respondent-Bank has rejected request of the petitioner on the ground that as per their record, DEEPAK BISSYAN 2025.12.11 17:06 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner submits that respondentBank transferred a sum of Rs.15,50,080/- which was lying in his father's account, however, has refused to transfer arrears of pension on the ground that his mother is nominee in the Pension Payment Order and as per Punjab Civil Services Rules, unless petitioner's name is entered in the service record, arrears of pension cannot be released. Petitioner's mother has already passed away, thus, he is entitled to arrears. 4.

Learned State counsel, on instructions from SI Paramjit Singh, Civil Suit Clerk, SSP Office, Gurdaspur, submits that State has no objection if retiral dues of deceased-employee are released to his son. 5.

Learned counsel for the respondent-Bank submits that retiral dues of deceased-employee were not released to petitioner awaiting consent from parent Department. In view of statement made by State, the Bank would release retiral dues of deceased employee to petitioner. 6.

In the wake of statement of both sides, the instant petition stands disposed of. Let the needful be done within a period of four weeks from today.
