Learned State counsel has filed status report dated 06.04.2026, which is taken on record. He refers to para 9, 10 as also Annexure R-1/T, as per which, the complaint submitted by the petitioner was filed, which read thus: "9. That the enquiry of application (P-8) was conducted by ASI Parvesh Kumar of Police Station Daba, Ludhiana. The petitioner had sought an enquiry in respect of FIR No. 56 dated 22.05.2025 registered under Sections 308(2) and 351(2) of the BNS at Police Station Daba. Upon perusal of the application, it was found that the aforesaid FIR had been registered on the statement of Harjit Singh (respondent No. 8) against the petitioner. During investigation, the petitioner was granted anticipatory bail by this Hon'ble Court on 21.08.2025 and thereafter joined the investigation on the same day.
The challan against the petitioner has already been presented before the learned Trial Court on 19.09.2025 and the matter is presently pending trial. The petitioner has the liberty to raise all his pleas before the learned Trial Court during the course of trial. Accordingly, no further action was found to be warranted on the application and the recommended to be filed. The report submitted by ASI Parvesh Kumar was duly approved by the SHO, Police Station Daba, Ludhiana and forwarded to the deponent.

CRM-M-66909-2025 (O&M) -210. That the deponent, after examining the report, concurred with the findings and forwarded the same to ADCP-II, Ludhiana, who also agreed with the report and further forwarded it to the Commissioner of Police, Ludhiana. The Commissioner of Police, Ludhiana, after due consideration, has seen and ordered the filing of the same on 14.11.2025. A copy of the said report is annexed herewith as Annexure R-1.

9. Detail of investigation:
Sir.
It is requested that investigation into the above said application has been conducted through Assistant Commissioner of Police, Industrial Area-B, Ludhiana. Application under the said subject has been given by applicant Amarjit Singh Dhamotia S/o Sh. Rai Singh R/o H. No. B-29-60/35-P-330, St. No. 08, Mohalla Maha Singh Nagar, PS Daba Ludhiana to cancel the case FIR No. 56 dated 22/05/2025 u/s 308(2)-351(2) BNS PS Daba. From the perusal of the contents of the application under subject it is found that on the statement of Harjit Singh S/o Sh. Devi Dayal R/o H. No. 08, Daba Lohara Road, Ludhiana case FIR No. 56 dated 25/05/2025 u/s 308(2)-351(2) BNS PS Daba was registered against applicant Amarjit Singh Dhamotia mentioned above.
During investigation into the case on dated 21/08/2025 applicant Amarjit Singh Dhamotia was joined into the investigation of the said case. On dated 19/09/2025 Challan of the case has been presented before the Hon'ble Court of Kavita Sharma, J.M.I.C. Ludhiana, and case is under trial. Applicant can present his case before Hon'ble Court by legal measures during trial. Application under the above said subject requires no action, as per the report of Assistant Commissioner of Police, Industrial Area-B, application is recommended to be filed in office.
