The instant petition under Section 482 of BNSS, 2023 (438 of Cr.P.C.), has been filed for grant of anticipatory bail to the petitioner in case FIR No.922 dated 03.07.2018, registered under Sections 406, 419, 420, 467, 468, 471 and 120-B of IPC, at Police Station City, Panipat, Haryana. 2.

Learned counsel for the petitioner contended that the petitioner, who is a lady, aged about 53 years, is suffering from health issues and due to the same, she failed to appear before the trial Court despite the direction of the Court. She also underwent a hip surgery. Learned counsel for the petitioner submitted that the petitioner is ready and willing to join the proceedings and limited her prayer to the extent that the petitioner be not arrested by the police.

Keeping in view the documents placed on record by learned counsel for the petitioner regarding non-appearance of the petitioner before the trial Court, the petitioner is directed to appear before the learned trial Court within a period of 15 days, i.e. up to 04.12.2025 and to move an appropriate application by raising all the pleas taken in this petition before the trial Court regarding her non-appearance. The trial Court is directed to decide her bail application in accordance with law. Till then, she will not be arrested by the police in this matter. It is made clear that if she fails to appear before the trial Court within stipulated time then the relief granted by this Court shall be deemed to be withdrawn.
