Present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India read with Section 3(1)(c) of the Punjab Good Conduct Prisoners' (Temporary Release) Act, 1962 with a request to issue directions to respondent No.4-District Magistrate, Moga to consider and decide the application for parole.

Learned counsel for the petitioner submits that petitioner had submitted Panchnama dated 09.08.2024 (Annexure P-1) for parole to the Superintendent, Central Jail, Faridkot but no action has been taken by the District Magistrate, Moga despite repeated reminders.

On the other hand, counsel for the National Investigating Agency and State counsel oppose the prayer on the ground that no specific application for parole was made and Annexure P-1 is an undertaking of the Sarpanch and Villager qua their no objection.

On this counsel for the petitioner submits that application has already RAJEEV PUROHIT 2025.11.27 10:00 I attest to the accuracy and integrity of this document been made which is endorsed at Sr. No. 10126 on 28.10.2024.

Given above, respondent No.3 is directed to refer case of the petitioner to respondent No.4 within 20 days after completing all formalties and the concerned Magistrate-respondent No.4 shall take decision on the same within 10 days of the receipt of proceedings in accordance with law. Order so passed by also communicated to the petitioner without any delay.

With the aforesaid direction, the present petition is disposed of. Pending application(s), if any, shall also stand(s) disposed of.
