The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of Serial No.4 of Advertisement No.10/2025 which is part of Advertisement No.7-16 of 2025 dated 15.07.2025 whereby respondent has invited applications for two posts of Assistant Director (Toxicology).

The petitioner was recruited as Senior Scientific Assistant Chemistry ('SSA') on 11.08.2009. He was promoted as Senior Scientific Officer on 17.07.2015. Next promotional post is Assistant Director (Toxicology) which is governed by Haryana Forensic Science (Group-A) Service Rules, 1980. The said Rules have been amended by Haryana PARAMJIT KAUR SAINI 2025.12.04 05:30 I attest to the accuracy and integrity of this document

CWP No. 34820-2025(O&M) -- Forensic Science (Group-A) Service (Amendment) Rules, 2012. As per applicable Rules post of Assistant Director has to be filled up at the first instance by promotion and if eligible candidate is not available by direct recruitment/deputation. The petitioner is having requisite experience as well as qualification, thus, for all intents and purposes he is eligible for promotion still respondent has advertised two posts of Assistant Director (Toxicology). This Court vide order dated 28.02.2012 passed in CWP No.8700 of 2011 directed the respondent to fill up post of Assistant Director through promotion in the light of applicable Rules.

Learned State counsel submits that Director General of Police has acceded to request of the petitioner for promotion. The matter has been put up before the Additional Chief Secretary to Government of Haryana, Home Department, Chandigarh, thus, grievance of the petitioner does not survive.

In the wake of statement of learned State counsel, the petition is disposed of with liberty to petitioner to file afresh if his grievance survives. 5.
