This petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of the order dated 05.04.2023 passed by the learned Judicial Magistrate First Class, Bathinda, whereby the bail bonds and surety bonds furnished by the petitioner were cancelled, non-bailable warrants were issued against the petitioner, and he was declared a proclaimed person in Complaint No. 2883 of 2019 dated 31.08.2019 under Section 138 of the Negotiable Instruments Act. 2.
Learned counsel for the petitioner submits that the petitioner could not appear before the learned Trial Court on 05.04.2023 as he had inadvertently noted down an incorrect date. Consequently, the learned Trial Court cancelled the bail bonds and surety bonds of the petitioner, issued non-bailable warrants, and declared him a proclaimed person. Learned counsel further submits that the petitioner is ready and willing to appear before the learned Trial Court to Renu Rawat 2026.01.21 16.19 I attest to the accuracy and integrity of this document

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order 05.04.2023 passed by ld. JMIC, Bathinda. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the application on the same very day. 7.
