Present second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

Role attributed to the petitioner is that of causing injuries to the injured Vijay Kumar and Seema Devi. Injuries suffered by them are detailed as under:- "(ii) Detail of MLRs (a) As per MLR No.RS/74/MLR/2024 dated 27.05.2024 (Civil

- 2 - Hospital, Malout) of the injured Vijay Kumar son of Sohan Lal Two injuries. Both the injuries were declared as grievous by the Doctor.

(b) As per MLR No.RS/75/MLR/2024 dated 27.05.2024 (Civil Hospital, Malout) of the injured Seema Devi wife of Rattan lal, there is one injury on her person. The injury No.1 was declared as dangerous to life by the Doctor."

After hearing the petitioner's counsel, on 10.02.2026, following order was recorded:- "i) Learned State counsel has filed reply by way of affidavit of Naveenpal Singh Lehal, PPS, Deputy Superintendet of Police, Sub Division Malout, District Sri Muktsar Sahib, in Court today. Same is taken on record. Registry is directed to tag the same at appropriate place with the paper-book.

ii) Petitioner is attributed with having inflicted Kappa blows on the right side of the head (twice). Injuries were suffered by Vijay and Seema Devi, who had tried to stop the petitioner from running away. Injured-Vijay has been examined and has supported the case of the prosecution; however, Seema Devi is yet to be examined and now the case is listed for examination on 09.03.2026.

iii) Let Seema Devi also be examined before the date fixed before this Court.

iv) List on 02.04.2026."

In view of the above, present petition is disposed of with a direction to learned trial Court to record the statement of injured Seema Devi at the earliest, along with the statements of other material prosecution witnesses, which are yet to be recorded.

Let the process of recording the statements of the prosecution witnesses be expedited.

However, petitioner shall be at liberty to file a fresh petition after completion of two years of incarceration period inside jail, in case the

Petition is disposed of in above terms.
