In the instant case, on 28.11.2025, following order was passed:- "i) Present petition has been filed under Section 528 of the BNSS seeking directions to the official respondents to initiate appropriate legal action by registering an FIR against the private respondents, who are alleged to have brutally assaulted and inflicted injuries upon the petitioner, which have been declared grievous. It is further prayed that the life and liberty of the petitioner and his family members be protected, as the private respondents are allegedly threatening them.

ii) It is informed that the petitioner himself is an accused in FIR No. 81 dated 23.07.2025, registered under Sections 115(2), 118(1), 126(2), 351(2), and 351(3) of the BNS.

iii) Learned counsel for the petitioner contends that in the same incident, petitioner also suffered injuries, including one declared grievous; however, no case has been registered by the police in this regard. iv) Learned State counsel is directed to file a status report in respect of the submissions addressed by the petitioner.

v) List on 15.12.2025."

In compliance to the order dated 28.11.2025, learned State counsel has filed the status report dated 12.12.2025 in Court today, which is taken on record. Office to tag the same at appropriate place. Paragraph No.9 of the aforesaid status report reads under:- "9.

That it is humbly submitted that, as per the record, ASI Naresh Kumar had earlier also asked the petitioner Ashwani Kumar to record his statement; however, the petitioner stated that he would do so at the Police Station after receipt of the medical opinion regarding his injuries.

Now, on 04.12.2025, Ashwani Kumar recorded his statement and the same pertains to the very incident for which Kiran Bala has already got FIR No.81 dated 23.07.2025 registered at Police Station Sadar, Pathankot. Therefore, on the basis of the statement of Ashwani Kumar, a cross-case has been registered in the present FIR vide DDR no.19 dated 04.12.2025. The Copy of DDR is annexed as Annexure R-1."

Having noticed that a cross-version has already been recorded at the instance of the petitioner on the basis of his statement, learned counsel for the petitioner does not press the instant petition. 5.
